1. Scope of application : These general terms and conditions apply to all orders and sales contracts placed by the client with the service provider named "Oneiropolis," represented by the association "L'Abeille Production"." No deviation from these general terms and conditions of sale shall be permitted without written confirmation from the seller.
2. The artistic performance : The performance is conducted with respect for and the well-being of all involved. The show is adaptable to various themes and venues whether for public or private evenings, theaters, events, or festivals; performed on stage, on the street, while moving among the audience, or at a fixed location such as a gallery. The aim of the performances is to provide entertainment and a moment of well-being and enjoyment for the audience, participants, and all those present. The artistic session begins at the start of the performance and concludes at its end. The performer will remain present for a period after the show to ensure that audience members have fully emerged from the state of fascination. Some audience members may react to the performer's suggestions during the show; this is a natural response among highly receptive individuals. The performer will be on hand to monitor the audience's state and well-being, and if desired to share this unique experience. Performances and participation are open to the general public. Young people may participate actively from the age of 14; minors must be accompanied by, or have the consent of, a parent or legal guardian, and the organizer is responsible for ensuring compliance with regulations regarding the supervision of minors.
3. Quotations : Requests for quotations must be made at least one month prior to the event date; quotations remain valid for 7 days following receipt of the service agreement. If the client fails to confirm their commitment by paying at least a deposit within this period, "Oneiropolis" service providers will no longer be bound by the offer made. Quotations and project proposals are provided free of charge. All our quotations are issued without obligation.
4. Contract : Following your request and mutual agreement regarding the date, venue, duration, and type of service, a price quotation detailing the agreed terms will be sent to the organizing party. Unless otherwise agreed, confirming the quotation and securing the booking requires payment of a deposit amounting to at least 50% of the agreed performance fee. The balance must be paid on the day of the event, prior to the performance. Unless otherwise agreed, the client bears sole responsibility in the event of a breach of contract. Any claims relating to the contract must be notified to the service provider no later than 7 days after the performance date; otherwise, such claims will not be considered. For public (non-private) events involving the playback of music or video, the client is responsible for paying any applicable copyright fees. In the event of cancellation, the deposit paid is non-refundable.
5. Prices and payment : All invoices and deposits are payable in Euros. Accepted payment methods are cash and bank transfer. Checks are not accepted. Unless otherwise agreed, a deposit of 50% of the total contract amount is required to confirm the agreement; this must be paid no later than seven days after receipt of the contract. The balance of the invoice must be paid on the day of the activity and prior to the performance. In the event of non-payment of any sales invoice by its due date, the client shall be liable to the service provider automatically and without prior formal notice. A maximum of two payment reminders will be sent to the client. In the event of non-payment following these reminders, a registered letter will be sent; this will incur interest at a rate of 15% per month, calculated from the date the debt arose until the full amount is paid, as well as a surcharge of €5 per document sent. The sending of a registered letter will incur a surcharge of €25. In the event of legal proceedings to recover any invoice, the client shall also be liable for reasonable recovery costs, such as legal, attorney, and bailiff fees.
6. Contract termination and non-performance : Except in cases of *force majeure*: If the client terminates the contract after acceptance, they shall be liable to pay the service provider by way of compensation a sum equal to the amount of the deposit paid or due. In the event that the service provider fails to perform the sales or service agreement and is unable to propose alternative entertainment options, thereby causing loss to the client, the service provider undertakes to refund the deposit and pay compensation equal to 25% of the sale price.
7. Force Majeure : In the event of any occurrence such as—but not limited to—epidemics, public transport disruptions, strikes, embargoes, wars, terrorist attacks (or their consequences), or severe weather, neither party may claim compensation from the other. In the event of force majeure, the deposit paid by the client will be refunded.
8. Publicity : For public (as opposed to private) events, "Oneiropolis" undertakes to publish details of the event agreed upon with the client on its website or social media pages. Such publication may take the form of a personal post, the client's promotional poster, or the client's slogan. The client is free to carry out their own advertising, at their own expense, to reach their desired audience for the event. Any such advertising must explicitly mention the name "Oneiropolis." If images are used, the service provider agrees to supply the necessary materials for creating the advertisement. Should the name or images of "Oneiropolis" be used without authorization, the individual or legal entity responsible shall be liable for the payment of compensation.
9. Governing Law and Jurisdiction : These General Terms and Conditions are governed by Belgian law. Any dispute relating to the formation, performance, or interpretation of these General Terms and Conditions of Sale or to any agreements to which they apply that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Brussels and the judicial authorities of the service provider's region.
